The 21st Roche Children’s Walk: Employees Raise Funds for Children with Cancer at Yayasan Kasih Anak Kanker Indonesia

Jakarta, 3 July 2024 – Roche Indonesia once again held its annual Roche Children’s Walk, a fundraising event by Roche employees worldwide aimed at helping children in need both locally and globally. This year marks the 21st anniversary of the event. Through creative means such as bazaars, food sales, talent shows, running, and offering various services, Roche Indonesia employees successfully raised Rp 180,793,063. The funds were donated to children with cancer through Yayasan Kasih Anak Kanker Indonesia (YKAKI). The children supported by YKAKI come from low-income families and rely on financial assistance.

In a video message, Budi Gunadi Sadikin, the Minister of Health of the Republic of Indonesia, expressed his appreciation for the event. “May the donations for Yayasan Kasih Anak Kanker Indonesia greatly benefit the children under its care. I also hope that the dedication of all Roche Indonesia employees can inspire more parties to work together to realize the transformation of Indonesia’s health system,” he said. The Roche Children’s Walk is celebrated simultaneously in 75 countries and over 165 locations.

Funds raised by employees are matched by the company and used to support projects for children worldwide related to education, nutrition, primary healthcare, and social development. Globally, a total of CHF 23 million has been raised since the initiative began in 2003, collected by over 315,000 Roche employees.

In today’s highly competitive market, businesses constantly seek innovative ways to ensure exceptional service while safeguarding their reputation. One effective strategy is mystery shopping, a practice that offers invaluable insights into service quality and adherence to operational standards. Not only does it serve as a tool for performance evaluation, but it also plays a pivotal role in identifying and mitigating fraudulent activities that can jeopardize a company’s financial health and credibility.

As the name suggests, this activity is conducted covertly by trained investigators or mystery shoppers who pose as regular customers. How does mystery shopping uncover fraudulent activities? One approach is through product purchase tests, frequently conducted both online and offline.

Detecting Fraudulent Activities

In the effort to uncover fraudulent activities, product purchase tests often serve as scenarios where companies task mystery shoppers to buy specific items. Through these purchases, companies can evaluate employee behaviour in serving customers, their adherence to Standard Operating Procedures (SOPs), and identify gaps in internal oversight at their outlets. From various indicators, potentially fraudulent activities can be detected.

  1. Direct Observation of Procedures

Mystery shoppers can observe and report whether employees follow the procedures during transactions. For example, SOPs may require cashiers to provide purchase receipts to customers after each transaction.

Hence, it’s common to see signs at cashier counters stating “Free, if no receipt”. Receipts not only serve as proof of purchase but also offer additional benefits to customers, such as loyalty programs or discounts for future transactions.

  1. Transactions Verification, Discount Monitoring, and Promotions

Mystery shoppers can note transaction details, including amounts paid and change received, then compare this data with the receipt to ensure no discrepancies.

For instance, in a case, a cashier provided a receipt to a customer, but there was a discrepancy between the items purchased and those listed on the receipt, even though the amount paid matched what was stated. Such findings could indicate fraud.

Moreover, mystery shoppers can also check whether discounts and promotions are applied correctly. If employees offer unauthorized discounts or exploit promotions for personal gain, it can be reported as fraudulent behaviour.

Therefore, companies need to conduct further investigations to determine whether these discrepancies were intentional or the result of human error.

  1. Observing Internal Oversight Gaps

Internal control plays an important role in ensuring operational compliance and reducing the potential for fraud. In another case, for instance, at a fast-food outlet, their SOP stipulates that food served must be kept in the food warmer holding cabinet for only a few hours to maintain quality. However, each outlet also has targets to minimize food wastage.

In this case, the findings from mystery shopping revealed that the quality of the food served did not meet expectations. With such findings, the company should initiate a thorough investigation, exploring the potential shortcomings in internal controls at their outlets.

Focus on findings and investigation

Prioritizing findings and investigations are crucial in the ongoing activities of mystery shopping programs.

Findings may not always be directly conclusive evidence, but often the information recorded in reports can serve as valuable clues for companies to conduct further investigations. This allows companies to take appropriate and decisive steps to protect their assets, enhance integrity, and improve service quality for their customers.

A recent study dated between 2010 and 2015 from IDH The Sustainable Trade Initiative mentions roughly 122.29 million hectares (Mha) of tree cover were lost – representing around 5% of the total area covered by natural forests in 2010. Beyond the immediate socio-economic and environmental consequences of this transformation, deforestation and land-use changes stand as the second-largest human-induced source of greenhouse gas (GHG) emissions, significantly contributing to climate change. The European Union emerged is one of the major importers of commodities linked to deforestation: over 60% of the world’s cocoa and approximately 50% of coffee being directed to Europe. Simultaneously, cocoa and coffee constitute 2 out of 7 agricultural commodities that played a role in contributing to over 25% of the global tree cover loss between 2001 and 2015, per the World Resources Institute in 2022.

The regulation mandates compliance from over 50,000 businesses that import or process any of the key seven commodities, including Palm Oil, Cocoa, Coffee, Rubber, Wood, Soy, Cattle, and derivatives such as leather and furniture. Additionally, non-EU companies heavily involved in EU activities are required to adhere to these regulations. In 2016, France enacted Loi Sapin II, positioning itself as one of the early adopters of whistleblowing legislation within the European Union. The primary focus of this law is to combat corruption and bribery within French companies.

Sapin II has left a significant and enduring impact on French anti-corruption law. It introduced a stricter regulatory framework and fostered a more responsible business environment. This advancement is noteworthy, especially considering that prior to Loi Sapin II, France faced criticism for lagging behind other EU countries in addressing these issues.

One of the key provisions of the law mandates the establishment of an internal reporting mechanism within organizations. This mechanism, often referred to as the whistleblowing system, aims to facilitate the easy and safe disclosure of potential misconduct or breaches of the code of conduct by employees.

Similar to anti-corruption laws in other jurisdictions, such as the UK Bribery Act and the US Foreign Corrupt Practices Act, Loi Sapin II has extraterritorial reach. This implies that organizations meeting its criteria are subject to its provisions irrespective of their geographical location, with Swiss businesses not being exempted.

Navigating Loi Sapin II on whistleblowing practices

The Loi Sapin II mandates the establishment of a whistleblowing hotline for organizations meeting specific criteria, including:

  • Corporations with a workforce of at least 50 individuals and municipalities boasting 10,000 or more residents.
  • Corporations with gross revenue exceeding EUR 100 million
  • Foreign subsidiaries of French groups. Companies affiliated with a group whose parent organization’s headquarters are situated in France and have a global workforce of at least 500 employees

Swiss businesses, irrespective of their geographical location, are subject to anti-corruption regulations if they meet any of the aforementioned criteria. For instance, a Swiss engineering firm operating as a subsidiary of a French construction company must implement an anti-corruption program, which includes a whistleblowing system, covering its international operations.

To enhance the protection of whistleblowers, the “Waserman Law” was enacted the following year. This legislation aligns the nation’s legal framework more closely with the upcoming EU Whistleblower Protection Directive, thereby strengthening safeguards for whistleblowers.

While upholding key elements of Loi Sapin II, this law incorporates additional measures, including strengthening safeguards against retaliation, expanding the definition of whistleblowers, and providing them with career-long support.

Streamlining Compliance with Phoenix Whistleblowing Software

Forum Discussion: Indonesia-EFTA Comprehensive Economic Partnership Agreement (IE-CEPA)

On 16 December 2018, Indonesia and the EFTA States signed a Comprehensive Economic Partnership Agreement (IE-CEPA), which went into force on 1 November 2021.

To raise awareness and maximize the benefits of the Agreement, the Embassy of Switzerland in Indonesia and Indonesia SwissCham Ease of Doing Business Sectoral Group held a forum discussion on IE-CEPA Implementation on 26 March 2024 at the Embassy of Switzerland in Indonesia. Led by Khalid Ibrahim, SwissCham Head of Ease of Doing Business Sectoral Group and President Director of Novartis Indonesia, the forum discussion featured experts (online) from Switzerland:

  • Dominik Ledergerber, Senior Advisor EFTA Division of the State Secretariat for Economic Affairs
  • Claudia Brand, Deputy Head Free Trade Agreements of Swiss Customs

Unfortunately, the harsh truth is that many children had to be born in Indonesian prisons or brought to prison and then live alongside their inmate mothers who are serving their sentences and are being treated like prisoners.

In Indonesia, not many people know about or pay attention to these children. Lamtiar Simorangkir, along with her filmmaker community named Lam Horas Film, felt compelled to help pregnant inmates, especially children who are born and raised behind prison bars. Therefore, they have made a documentary film titled “Invisible Hopes.” The film takes a closer look at the lives of pregnant inmates and the children behind prison bars. Through this film, they hope to raise awareness and move the hearts of society and the Government to pay more attention to pregnant inmates, especially children behind prison bars.

They hope that the film can open a safe space for discussions in order to find better solutions. Therefore, this film was made as an impact campaign tool to raise awareness and advocacy for the rights of children and pregnant prisoners in Indonesia. The film was not made to vilify certain people or certain parties nor to blame them.

“Invisible Hopes” has won the most prestigious film festival in Indonesia, Festival Film Indonesia, and also Piala Maya, for categories of Best Feature Documentary and Best Directing for First Feature Film. During the awarding night of Festival Film Indonesia, when the Director/ Producer of “Invisible Hopes,” Lamtiar Simorangkir, was receiving the award, she asked everyone who attended and watched the event throughout Indonesia even boldly asked President Joko Widodo, who attended the event, to do something to save the children who are born and raise behind prison bars.

What Has Been Done

Since the shooting in 2018, Lam Horas Film has started to raise awareness and impact campaigns for pregnant inmates and children in prison. Currently, they have succeeded in reaching thousands of Indonesian people and related stakeholders. Through film screenings and discussions, lectures, and talk shows, they informed about the existence and challenges faced by pregnant prisoners and children in prison. Then, encourage the society and Human Rights Commissions to take part in helping and fulfilling their rights. The most important thing is to remind the Government that there are children who are the future of our nation who have become invisible victims in adult prisons that need to be saved, and that is the responsibility of the Government.

So far, Lam Horas Film has successfully carried out an impact campaign roadshow in 17 provinces in Indonesia and even abroad. The Impact Campaign roadshow has succeeded in producing recommendations and has been submitted to 8 Governmental institutions. They have also tried to help provide for the daily needs of babies and pregnant and breastfeeding mothers in prison.

Currently, Lam Horas Film is continuing its impact campaign and advocacy. This is done by following up on recommendations that have been submitted to the Government and building multi-stakeholder networks to jointly carry out concrete follow-up advocacy. Lam Horas Film is also making a sequel film that will uncover the heartbreaking reality of these children’s lives after they leave prison. This second film also will be used as an impact campaign and advocacy tool. They are also continuing to help provide for the needs of children and mothers in prison.

Lam Horas Film is a volunteer-based filmmaker community that makes films independently to raise important issues with the goal of bringing better change in Indonesia and hopefully also around the globe. They also have made other films that raised important issues, especially regarding women’s rights, children’s rights, and tolerance in Indonesia.
